Registration for any person who offers membership camping contracts for sale in Iowa.

Who Applies Any person who offers or sells a “membership camping contract” in Iowa must register. A membership camping contract is defined as any agreement offered or sold in Iowa giving the purchaser the right to use the membership camping operator’s campground(s) for more than thirty (30) days during the term of the agreement. The registration requirements of Iowa Code Chapter 557B do not apply to: 1. The operator of a manufactured home community or a mobile home park as defined in Iowa Code Chapter 435 or Iowa Code Chapter 562B; 2. An offer, sale or transfer by any one person of not more than one membership camping contract in a twelve-month period; 3. An offer or sale by a government, government agency, or subdivision of government; 4. A bona fide pledge of a membership camping contract; or 5. Any transaction relating to an interest in a time share subject to regulation pursuant to Iowa Code Chapter 557A.
When To Apply Application must be made prior to offering memberships for sale.
Initial Requirements Must provide all information and sample documents requested in initial application. Must be financially sound. Must comply with nondisturbance provisions of Iowa Code section 557B.12. Must promptly report any changes to information supplied in initial application or previous renewal.
Duration Registration must be renewed annually. Application for renewal must be filed 30 days before registration expires.

Additional Information Any person offering or selling campground membership contracts in Iowa is also required to provide specific written disclosures to a purchaser before the purchaser signs a contract or gives the seller money or anything else of value for the purchase of the campground membership. The failure to deliver the proper disclosures to the purchaser, or the failure to properly register to sell membership campground contracts in Iowa, exposes the violator to substantial penalties under both the Membership Campgrounds Act (Iowa Code Chapter 557B) and the Consumer Fraud Act (Iowa Code section 714.16).
