Section 401 requires the Department of Natural Resources to certify that the proposed project will not violate state water quality standards.

Who Applies Anyone required to obtain a Section 401 Water Quality Certificate.

When To Apply A minimum of one hundred and twenty days before construction begins.

Initial Requirements Check with the Corps of Engineers for a Section 404 permit if dredging or filling activities are planned. If it is required, application for state water quality certification can be made on the same form used to apply for DNR Flood Plain/Sovereign Lands permits/Corps Section 404 permit –Joint Application Form Protecting Iowa Waters, (https://programs.iowadnr.gov/permt). Corps of Engineers 309.794.5057.

Duration Valid until the applicable Federal permit or license expires.

Processing Time Processing time averages 60-120 days.
