Any qualified nonprofit corporation may apply to the Iowa Racing and Gaming Commission for a license to conduct casino gambling on qualified excursion gambling boats. Any boat operator that enters into a management contract or operation agreement with a qualified nonprofit corporation may apply to the Commission for a license to operate an approved excursion gambling boat. The operator shall be subject to the same conditions of licensing, statutory provisions and administrative rules as the qualified nonprofit applicant and licensee. An application submitted by a qualified nonprofit corporation in conjunction with a boat operator shall be considered to be one application. \\\\”Gambling game\\\\” means any game of chance authorized by the commission. Code Citation Iowa Code Chapter 99F Who Applies \\\\”Qualified sponsoring organization\\\\” means a nonprofit corporation organized under the law of this state, whether or not it is exempt from federal income taxation, or a person or association that can show to the satisfaction of the Commission that the person or association is eligible for exemption from federal income taxation under section 501(c)(3), 501(c)(4), 501(c)(5), 501(c)(6), 501(c)(7), 501(c)(8), 501(c)(10), or 501(c)(19) of the Internal Revenue Code as defined in section 422.3. When To Apply The application should be filed with the administrator of the Commission at least 90 days before the first day of the next excursion season as determined by the Commission. Initial Requirements When making application to the Commission, applicants shall identify the excursion gambling boat upon which gambling games will be authorized and specify the exact location where the excursion gambling boat will be docked. Application shall be made in a form containing information as the Commission prescribes. The minimum passenger capacity of an excursion gambling boat is 250 persons. A license to conduct gambling games on an excursion gambling boat in a county shall be issued only if the county electorate approves the conduct of the gambling games. The applicant shall post a bond to the state of Iowa before the license is issued in a sum fixed by the Commission. Duration One year. Processing Time Up to 9 months processing time, including competitive application process and suitability investigation. Fee Structure The annual fee to operate an excursion boat is based upon the passenger carrying capacity, including the crew, for which the excursion boat is registered.
