A qualifying organization, as defined in section 513 (d)(2)(C) of the Internal Revenue Code, as defined in section 422.3, exempt from federal income taxation under sections 501(c)(3), 501(c)(4), or 501(c)(5) of the Internal Revenue Code or a nonprofit corporation organized under the laws of this state, may apply to the Commission for a license to conduct horse or dog racing. A license to operate gambling games shall be issued only to a licensee holding a valid license to conduct pari-mutuel dog or horse racing pursuant to chapter 99D on January 1, 1994. For racetrack enclosures, \”gambling game\” does not include table games of chance or video machines.

Who Applies A person holding a valid license to conduct pari-mutuel dog or horse racing.

When To Apply Application must be filed at least 60 days before the first day of the horse race or dog race meeting which the organization proposes to conduct, and shall be in a form and contain information as the Commission prescribes.

Initial Requirements Upon application, the Commission shall license the licensee of a pari-mutuel dog or horse racetrack to operate gambling games at a pari-mutuel racetrack enclosure. If the operations of gambling games at the pari-mutuel racetrack is not approved by a majority of the county electorate voting on the proposition at the election, the Commission shall not issue a license to operate gambling games at the racetrack.
